Insurance and Helmet Mandatory for Electric Vehicles – Delhi High Court

New Delhi: While it is mandatory to wear helmets while driving two-wheelers, it is seen that some people using electric vehicles are not wearing helmets. The Delhi High Court has said an important thing in this matter.

While insurance and helmets are mandatory for petrol-powered two-wheelers, the same applies to electric two-wheelers, the Delhi High Court has said, prompting legal action to be taken against violators. Dismissing a public interest litigation filed to make insurance and helmets mandatory for two-wheeler electric vehicles (EVs), the Delhi High Court said the court was asked to direct the government authorities to make helmets mandatory for all types of electric motorcycles and scooters.

The high court’s order came while dismissing a public interest litigation (PIL) seeking directions to the authorities to make insurance coverage compulsory for electric two-wheelers in accordance with the provisions of the Motor Vehicle Act.

A bench of Chief Justice Satish Chandra Sharma and Justice Subramonium Prasad said the PIL was filed solely on the basis of two news reports and the claims, allegations and issues raised by the petitioner largely remain unsubstantiated and that such “frivolous PILs”, instead of enabling access to justice, actually hinder it by “wasting precious judicial time”.
