Sambalpur: Disability of a Junior Engineer due to medical negligence: 2 doctors, private hospital will count a fine of Rs. 78 lakhs
Sambalpur: Government doctors are greedy for money. A doctor in Vimsar, who was greedy for money, persuaded the patient’s family to transfer him from Burla to a private hospital in Sambalpur. Due to medical negligence, the concerned patient, Sumit Das, a young software engineer, became disabled.
The district camp dispute resolution forum (Khauti Adalat) has taken a strict approach during the trial of this case. Suraj Jain, a doctor working in Vimsar’s intensive care unit, Sanjay Bhoi, a doctor at Sparsh City Hospital, and Sparsh City Hospital have been ordered to pay Rs 20 lakh each as compensation to Sumit Das, the complainant. Not only that, these three parties have been ordered to pay an average of Rs. 2 lakh 41 thousand 101 for medical expenses and Rs. 16 lahks 25 thousand 40 for the loss of income of the client. They have been ordered to pay a total of Rs 78 lakh 66 thousand 141 for compensation, medical expenses, and loss of income.
According to information, Sumit Das of Modipada, Sambalpur met with an accident on November 8, 2017, at 10:00 pm while traveling from Sambalpur on urgent work. His right leg, foot, and hand were injured. Sumit was admitted to Vimsar for treatment. Suraj Jain, a doctor from the Department of Orthopedics, came to treat Sumit at 2:30 that night. Doctor Jain said to Sumit’s brother Amit, in Vimsar surgery will be done after 4 days, but in a private hospital, surgery will be done in one day. On the advice of Dr. Jain, Amit admitted his brother Sumit to Sambalpur Sparsh City Hospital on 9 November 2017. Dr. Jain’s negligence in treatment led to infection after surgery.
However, as per his advice, they had to be rushed to various doctors and hospitals. Between 2017 and 2019, Sumit went to various doctors and hospitals. Not only that, Sumit and his family also had to suffer mental agony. Meanwhile, on 2 July 2018, Sumit received an employment letter from Infosys with a salary of Rs 27,084 per month. Due to medical negligence, he could no longer join the job as his legs and hands were not in functional condition. A handsome and talented young software engineer becomes disabled due to medical negligence. He still has to take medicine.
In view of these considerations, District Camp Disputes Resolution Commission President Ramakant Sathpathi and member Sadanand Tripathi today ordered the three parties to pay a total of 78 lakh 66 thousand 141 rupees for compensation, medical expenses, and loss of income. Interest at the rate of 12 percent per annum is ordered to be paid if the compensation amount is not paid within one month. Senior lawyer Prem Prakash Panigrahi and his associates handled the case on behalf of the complainant Sumit Das and his father Arvind Das.
