Sambalpur: Fraud to customers while selling old cars: First owner, R.T.O including other 3 punished and fined of rupees one and a half lakhs
Sambalpur: Cheating to a customer while selling old cars. When the disputed car was seized by the police, the second customer faced many problems even after paying all the money. The Sambalpur Consumer Court tried the case and punished the first owner of the vehicle, company who sold the vehicle to the second customer and Sambalpur RTO.
In this case, the company that sold the vehicle has been ordered to return the money deposited by the second owner of the vehicle and the money he sent to the bank account with an interest rate of 4 percent per annum. Not only that but the court also ordered company, the first owner who sold the vehicle and Sambalpur RTO to pay a fine of Rs 50,000.
According to the complaint, Sambalpur Dist. Rajkumar Sathpathi of Jamankira Thana Tikilipada decided to buy a car in 2016. For this, he went to an old car showroom in Ainthapali on January 16, 2016 and saw the car. At this time, he chose a car and paid an advance deposit of 5000k in the showroom to buy it. According to the agreement, on 20th day, Mr. Sathpathi deposited the outstanding amount of Rs. 2 lakh 65 thousand rupees and brought the vehicle.

Earlier, this car was in the name of Bisheswar Panigarahi, a resident of Bagdoli village in Khambeshwaripali, Subarnapur. So Mr. Sathpathi spent 3 thousand rupees for the transfer of ownership. On February 3, 2016, Mr. Sathpathi received the car RC from the office of RTO Sambalpur. Earlier, when Mr. Sathpathi spoke to the bank to finance the road, he was told that the financing would be done after the arrival of RC. So after the arrival of RC, Mr. Sathpathi went to the bank and sanctioned the lease.
Later Mr. Sathpathi was giving EMI to the bank for car. On December 4 of that year, Mr. Sathpathi was coming to Sambalpur for his father’s health. Meanwhile some strangers tried to take the car. As a result, Mr. Sathpathi ‘s driver took the car and parked in the premises of Dhanupali police station and took his father to the hospital. His father passed away on the 8th of that month. In January 2017, when Mr. Sathpathi went to Dhanupali police station to fetch the vehicle, he came to know that the vehicle was kept at the town police station and the bank had filed a case for non-payment of the pre-financing of the vehicle. How the vehicle was sold to him without the vehicle finance clearance. He then contact the first owner, second hand showroom, Sambalpur RTO.
No one helped him even after repeated attempts. As a result, Mr. Sathpathi was also defrauded by paying the money for the vehicle and paying the bank EMI. But even after repeated complaints, he was referred to the consumer court due to no success.
